FusionLab User Terms Agreement

Thank you for choosing FusionLab for your graphic design, website, custom modeling, and scripting needs. By engaging with our services, you agree to abide by the following terms and conditions. Please read this agreement carefully.

1. SERVICES

I. Graphic Design Services:
FusionLab offers graphic design services, including but not limited to, logo design, branding, marketing collateral, and digital design.

II. Website Design and Development:
FusionLab provides custom website design and development services, including front-end and back-end design, user experience (UX) design, and website maintenance. The scope of work will be defined in the project proposal or agreement, with any changes to the scope to be agreed upon in writing.

III. Custom Modeling and 3D Design:
FusionLab offers custom 3D modeling services, including but not limited to, product design, vehicle modeling/rendering, and character modeling. All work will be detailed in the project proposal. Any changes to the scope of the 3D modeling work must be agreed upon in writing.

IV. Scripting and Software Development:
FusionLab provides scripting and software development services, including custom scripts, automation tools, and integrations. The scope, features, and specifications of custom scripts or software will be outlined in the project proposal.

V. Software Services:
FusionLab offers both custom software development and purchasable software solutions. Upon purchase or order, all software remains the property of FusionLab, and clients do not have the right to resell or redistribute the product.

2. PAYMENT

I. Fees:
Clients are required to pay the agreed-upon fees outlined in the project proposal or agreement. A 30% down payment is required upfront before work commences. The remaining balance is due according to the payment schedule specified in the proposal. If clients fail to make the required payment, FusionLab will not provide the completed work.

II. Payment Schedule:
Payment schedules will be detailed in the project proposal. Failure to adhere to the payment schedule may result in project delays, work suspension, or termination.

III. Additional Costs:
Clients may be responsible for additional costs related to services or modifications outside the initial scope of work. Any additional costs will be communicated and agreed upon before implementation.

IV. No Refund Policy:
Refunds for creative services, website development, custom modeling, and scripting will not be provided once the service has been initiated or completed unless there are substantial issues affecting the quality or scope of the service.

V. Refund Exceptions:
Refunds may be considered on a case-by-case basis under exceptional circumstances, solely at the discretion of FusionLab.

3. INTELLECTUAL PROPERTY

I. Ownership:
Upon full payment, the client owns the final designs and website content. FusionLab retains the right to showcase the work in portfolios or promotional materials.

II. License:
FusionLab grants clients a non-exclusive, worldwide license to use the final designs, website, and software for their intended purpose. This license is revocable only if the client violates the terms of use.

4. DESIGN REVISIONS

I. Revision Limits:
The project proposal will specify the number of design revisions included. Additional revisions may incur extra charges. For websites, custom modeling, and scripting, any changes outside the original scope will be treated as additional work and billed accordingly.

5. CONFIDENTIALITY

Both FusionLab and the client agree to keep confidential all information exchanged during the project, including concepts, drafts, proprietary information, and any business-related details. This confidentiality extends to all designs, scripts, and technical solutions developed.

6. TERMINATION

Either party may terminate the project with written notice. In the event of termination, the client is responsible for payment for services rendered up to the termination date. Termination will not affect the ownership rights of the work completed before the termination.

7. CLIENT RESPONSIBILITY

Clients are responsible for providing timely feedback, necessary information, and approvals to ensure project timelines are met. Clients are also responsible for ensuring that all content provided to FusionLab is accurate and legally compliant.

8. PRIVACY

FusionLab ensures user privacy while utilizing email services, web services, and forms. Any information exchanged between FusionLab and the client will remain private and only shared with relevant FusionLab staff or contractors involved in the project.

9. DISCLAIMER

FusionLab is not liable for the client's use or misuse of the final designs, website, custom models, or any third-party claims arising from the use of the delivered services. Clients assume full responsibility for complying with copyright, trademark, and other legal requirements related to the use of FusionLab's work.

10. WEBSITE PURCHASING

I. Domain and Hosting:
FusionLab does not provide domain registration or hosting services unless otherwise specified in the project agreement. Clients are responsible for securing and maintaining their domain and hosting services unless otherwise agreed upon.

II. Website Maintenance:
Website maintenance services, including updates, backups, and troubleshooting, will be offered at an additional cost unless specified in the project proposal. Clients are encouraged to engage FusionLab for ongoing support to ensure the continued functionality and security of their website.

11. CUSTOM MODELS AND SCRIPTS

I. Model Ownership:
Upon full payment, the client owns the final 3D models or custom assets. FusionLab retains the right to showcase the work in portfolios or promotional materials. However, FusionLab may not resell or distribute these models without client consent.

II. Scripting Ownership:
FusionLab grants clients full rights to the custom scripts developed for their project upon full payment. FusionLab retains the right to use these scripts in their portfolio but will not distribute or resell the client's proprietary code without permission.

12. CHANGES TO TERMS

FusionLab reserves the right to update these terms and conditions at any time. Clients will be notified of significant changes. Continued use of FusionLab services constitutes acceptance of any updated terms.
